Function, Land Registry, real estate registerFunkce katastru nemovitostí Abstrakt Předmětem této diplomové práce je pojednání o funkcích katastru nemovitostí. Po úvodním seznámení se základními znaky katastru nemovitostí jsou probírány jednotlivé přístupy k jeho funkcím. Následuje výklad o funkci evidenční, informační, ochranné a intabulační, který vysvětluje podstatu každé funkce a uvádí instituty účinné právní úpravy, které jsou s danými funkcemi spojeny. Vedle toho jsou zmiňovány nedostatky účinné právní úpravy či výkladové neshody, které jsou dále diskutovány a v některých případech je formulováno možné řešení. Evidenční funkce spočívá v evidování určitého souboru údajů. V prvé řadě je představen předmět evidence, tedy jednotlivé nemovitosti, které jsou v katastru nemovitostí evidovány. Samotný obsah evidence pak tvoří stanovené údaje ohledně nemovitostí a ohledně osob. Informační funkce zase souvisí s označením katastru nemovitostí za veřejný seznam a s úpravou formální publicity. Představeny jsou rovněž všechny formy poskytování údajů. Jsou- li zapsané údaje spolehlivé, úplné a odpovídající skutečnému stavu, pak je plněna také funkce ochranná. Diskutováno je její zakotvení v občanském zákoníku a úprava materiální publicity, stejně jako její význam pro nakládání s nemovitostmi. Intabulační funkce pak souvisí se zápisy do katastru nemovitostí....
The Functions of the Land Registry Abstract This diploma thesis deals with functions of the Czech Land Registry. After an introductory part describing the basic features of the Land Registry, individual approaches to its functions are debated. The following is an explanation of the recording, information, protective and intabulation function, which discusses the essence of each function and lists the institutes of effective legislation that are associated with these functions. In addition, shortcomings in effective legislation or inconsistencies of interpretation are mentioned, and, in some cases, a possible solution is formulated. The recording function consists in recording a certain set of data. First of all, the subject of registration is introduced, ie individual real estates that are registered in the Land Registry. The content of the Registry consists of specified data regarding real estates and regarding persons. The information function is related to the designation of the Land Registry as a public list and to the regulation of formal publicity. All forms of data provision are also presented. If the recorded data are reliable, complete and corresponding to the actual state, then the protective function is also fulfilled.
