Abstract

Trest domácího vězení, jeho výkon a kontrola Abstrakt Tato práce se zabývá trestem domácího vězení. Popisuje právní úpravu tohoto trestu, dále zhodnocuje praxi a upozorňuje na nedostatky. Práce nejdříve vymezuje český systém trestů ukládaných za trestné činy a popisuje, jaké je postavení trestu domácího vězení v tomto systému a jaký je jeho vztah k ostatním trestům. Práce dále rozebírá hmotněprávní úpravu trestu domácího vězení v trestním zákoníku, vysvětluje nejasnosti v úpravě a snaží se doporučit změny, které by mohly této úpravě prospět. Poté práce řeší právní úpravu přeměny trestu domácího vězení na trest odnětí svobody, která nastává pří porušení výkonu trestu domácího vězení. Kromě toho se také zaobírá právní úpravou přeměn ostatních trestů na trest domácího vězení, upozorňuje na její nedostatky a navrhuje změny. Kromě hmotněprávní úpravy popisuje práce i výkon trestu domácího vězení a všechny s tím související případy, kdy trest domácího vězení nelze vykonávat. Dále práce popisuje dva způsoby, kterými se trest domácího vězení kontroluje. Punishment of house arrest, its execution and control Abstract This thesis deals with the punishment of house arrest. It describes the legal regulation of this punishment, further evaluates the practice and draws attention to the shortcomings. The thesis first defines the Czech system of punishments imposed for criminal offenses and describes the position of the punishment of house arrest in this system and its relationship to other punishments. The thesis further analyzes the substantive legislation of the punishment of house arrest in the Criminal Code, explains the ambiguities in the regulation and tries to recommend changes that could benefit this regulation. Moreover, the thesis deals with the legal regulation of the conversion of a punishment of house arrest sentence into a custodial sentence, which occurs when the execution of the punishment of house arrest sentence is violated. In addition, it deals with the legal regulation of the conversion of other punishments into the punishment of house arrest, draws attention to its shortcomings and proposes changes.
