Abstract

Umělá inteligence jako výzva pro soukromé právo Abstrakt Předmětem této diplomové je soukromé právo a umělá inteligence. Hlavním cílem této práce je analýza soukromoprávních aspektů umělé inteligence a zhodnocení současné právní úpravy ve vztahu k této technologii. Práce se proto zejména zabývá postavením umělé inteligence v rámci současného práva a možným udělením statusu elektronické osoby. Dále se pak věnuje otázce vhodné regulace umělé inteligence v budoucnu. První část práce je věnována primárně pojmu umělé inteligence, jejímu významu pro společnost a právo a jejím rizikům. Primárním cílem této kapitoly je seznámení čtenáře s fungováním umělé inteligence jako technologie s přihlédnutím k jejím odlišnostem oproti jiným technologiím, zejména k její autonomii. Druhá část práce je pak zaměřena na kritický rozbor umělé inteligence z hlediska současného práva, podle kterého je možné umělou inteligenci považovat za věc v právním smyslu, výrobek či autorské dílo. Část této kapitoly je také věnována problematice ochrany děl či vynálezů vytvořených umělou inteligencí a v souvislosti s tím úvahám o umělé inteligenci jakožto autorovi či původci vynálezu. Artificial intelligence as a challenge to private law Abstract The subject of this master thesis is private law and artificial intelligence. The main goal of this thesis is the analysis of private law aspects of artificial intelligence and the evaluation of current laws regarding this technology. Therefore, the thesis mainly deals with the legal status of artificial intelligence within the current law and the possible granting of the status of an electronic person. It also deals with the issue of appropriate regulation of artificial intelligence in the future. The first part of the thesis is focused primarily on the concept of artificial intelligence, its importance for society and law and its risks. The primary goal of this chapter is to acquaint the reader with the functioning of artificial intelligence as a technology, while considering its differences from other technologies, especially its autonomy.
