Právní aspekty měny a peněžního oběhu

Abstract

Měnové právo, pod které můžeme zařadit tuto diplomovou práci s názvem "Právní aspekty měny a peněžního oběhu", je součástí finančního práva, přesněji je výsečí jeho zvláštní části. Již z tohoto zařazení je evidentní blízkost tohoto oboru právní vědy s vědou jinou, s vědou ekonomickou. Právě z toho jsem se snažil při psaní této práce vycházet a v její první části se proto zabývám penězi obecně, charakterizuji jsem je z hlediska ekonomického, stručně nastiňuji jejich vývoj a také vývoj vybraných ekonomických i sociologických jich se týkajících teorií. Zároveň je odlišuji mimo jiné od dalšího institutu, který má k právu již blíže a kterým je měna. Ve druhé části této práce se věnuji českým zákonným penězům - koruně české - jednak z pohledu jejich zákonné úpravy, kterou charakterizuji a posuzuji její prvky, tak i z pohledu současné soustavy českých zákonných platidel. Jak zákonnou úpravu i soustavu českých platidel hodnotím a snažím se nalézt jejich slabší stránky, které by potenciálně mohli zákonodárce nebo emitent odstranit. V závěru stejné části se také zamýšlím nad budoucností současné soustavy českého oběživa a shledávám, že Česká národní banka jako vydavatel zákonných peněz se v současnosti nachází před rozhodováním o jejich budoucnosti s ohledem na přijímání eura. Monetary law, under which we could subsume this diploma thesis entitled "Legal aspects of currency and money circulation", is a part of financial law, more precisely it is a section of its special part. Already from this classification, the proximity of this field of legal science with another science, with economic science, is evident. This is exactly what I tried to base the writing this thesis on and so in its first section I deal with money in general, I characterize it from an economic point of view, I briefly outline their development and development of selected economic and sociological theories. I also distinguish it from another institute, which is already closer to the law and which is the currency. In the second section of this work I deal with the Czech legal tender - the Czech crown - both from the point of view of their legal regulation, which I characterize and assess its elements, and from the point of view of the current system of Czech legal tender. I evaluate both the legal regulation and the system of Czech currency and try to find their weaknesses, which could be potentially eliminated by the legislator or the issuer.
