Činnost mimořádných lidových soudů v období let 1945 - 1948

Abstract

ČINNOST MIMOŘÁDNÝCH LIDOVÝCH SOUDŮ V OBDOBÍ LET 1945-1948 Abstrakt Cílem mé disertační práce byl rozbor dekretální normotvorby ve vztahu k činnosti mimořádných lidových soudů v jednotlivých regionech, jako prostředku potrestání válečných zločinců, zrádců a kolaborantů. Retribuční soudnictví bylo reakcí na válečné události. Právní předpisy k oběma tématům nebyly vytvářeny živelně v reakci na konec válečného konfliktu, ale byly dlouhodobě připravovány již na úrovni exilové vlády a mezinárodních organizací ještě za doby války. Cílem autora bylo mimo obecného výčtu a popisu základního dekretálního zákonodárství, čtenáři přiblížit uvádění těchto předpisů do praxe v rámci neuspořádané doby poválečného Československa. Za tímto účelem byly využity prováděcí předpisy, a to nejen na úrovni vyhlášek, ale byly vytěženy i směrnice, pokyny či výkladová stanoviska, která podrobněji rozváděla poměrně strohá ustanovení dekretu, ale i reagovala na aktuální výkladové problémy dané doby. Dále byly za účelem naplnění tohoto cíle zpracovány konkrétní trestní případy projednávané ze strany MLS, aby tak autor ilustroval praktickou realizaci předpisů o retribučním soudnictví v českých zemích. K naplnění cílů autora byly dále využity archivní prameny, zejména Státního oblastního archivu Praha, Fond MLS Praha, kde jsou uloženy spisy...

ACTIVITIES Extraordinary People's Courts in the period 1945- 1948 Abstract The purpose of my PhD. Viva thesis was analysis of standards created on the basis of the Decrees in relation to to the activities of Extraordinary People's Courts in individual regions, as a means to punish war crimes, traitors and collaborators. Retributive justice was a response to the events of the war. The legal regulations concerning both topics were not created spontaneously in response to the end of the wartime conflict, but were prepared over an extended period by the government in exile and international organisations during the war. As well as a general list and description of the basic Decree legislation, the author's goal was also to describe to readers implementation of these regulations during the chaotic post-war period in Czechoslovakia. Implementary regulations were used for this purpose, not only on the level of decrees, but also in the form of guidelines, instructions or interpretive standpoints, which expounded the fairly terse provisions of the Decree and also responded to the current problems concerning interpretation at the time.
