Abstract

Medical devices Abstract The subject of this master thesis is the issue of medical devices. This thesis focuses on its reimbursement regulation. The work is divided into six chapters. The introductory explanation is devoted to the concept of medical device and it analyzes both the European definition of medical device and the national legal definition. The next part of the chapter emphasizes various division of these products, namely its variants, types and also classification of medical devices according to risk classes. The second chapter describes legal sources. The attention is paid to international sources of law, then furthermore to European law, from current directives to new regulations, which will come into force in 2020. In this chapter is generally discussed what changes this new regulations bring, as it is further elaborated in the next chapter. Last but not least, the national sources of law are analyzed. The legal regulation enriched by the outline of the future legal regulation awaiting the area of medical devices is widely mentioned. The next chapter defines institutions. Zdravotnické prostředky Abstrakt Předmětem této diplomové práce je problematika zdravotnických prostředků. Předkládaná práce pojednává o této problematice s akcentem na její úhradovou regulaci. Práce je po obsahové stránce rozdělena do šesti kapitol. Úvodní výklad je věnován pojmu zdravotnického prostředků a je rozebrána jak evropská definice zdravotnického prostředků, tak vnitrostátní zákonná definice. Další část kapitoly se zabývá nejrůznějším dělením těchto výrobků, konkrétně jeho variantami, druhy a také klasifikací zdravotnických prostředků dle rizikových tříd. Druhá kapitola je věnována právním pramenům. Kapitola nás seznamuje nejdříve s mezinárodními prameny práva, dále jsou především rozebrány prameny práva evropského, a to od aktuálních směrnic po nová nařízení, jejichž účinnost nastane v roce 2020. V této kapitole je dále obecně pojednáno o změnách, které přinesou nová nařízení a které jsou dále rozvedeny v následující kapitole. V neposlední řadě jsou analyzovány vnitrostátní prameny práva. Široce je zmíněna zákonná úprava obohacena o nastínění budoucí právní úpravy, která čeká oblast zdravotnických prostředků. Další kapitola je věnována institucím. Ministerstvo zdravotnictví i Státní ústav pro kontrolu léčiv jsou stěžejními institucemi v oblasti ZP, nejsou však jedinými orgány, které vykonávají...
