Abstract

Criminal Law Instruments Against Organized Crime Abstract This master's thesis elaborates an in-depth analysis of criminal law instruments used in a fight against organized crime. Given that organized crime, and criminal offences committed in an organized manner in general, represent one of the gravest forms of criminal behaviour, these legal institutes are of utmost importance in the contemporary debate on this topic, led by both scholars and the wider public. The first part of this thesis introduces the notion of organized crime. It further demonstrates the inherent difficulties in defining this notion and enumerates the different approaches that may be taken in respect of its classification. Lastly, it categorizes legal instruments the objective of which is to eradicate this phenomenon. The second part conducts a detailed examination of intensified criminal law repression of organised crime. In this respect, the thesis puts special emphasis on the intricacies associated with the punishment of offences perpetrated by an organized criminal group and their individual perpetrators. Trestněprávní nástroje boje s organizovaným zločinem Abstrakt Diplomová práce se zabývá vybranými právními nástroji boje s organizovaným zločinem. Vzhledem ke skutečnosti, že organizovaný zločin či obecně kriminalita páchaná organizovaným způsobem představuje nejzávažnější trestnou činnost, se jedná o velmi významné instituty, o jejichž jednotlivých aspektech se stále vede v rámci odborné i laické veřejnosti živá diskuze. První část této práce je úvodem do problematiky organizovaného zločinu. Je poukázáno na obtíže spojené již s definováním organizovaného zločinu či kriminality a dále uvedeno více možných kategorizací organizovaného zločinu a nástrojů, jejichž účelem je mj. jeho potírání. V části druhé je velmi podrobně analyzována právní úprava zpřísněné trestní represe vůči organizovanému zločinu, přičemž zvláštní pozornost je dána vybraným otázkám sankcionování pachatele trestného činu účasti na organizované zločinecké skupině. Třetí část této práce je věnována problematice spolupracujícího obviněného, korunního svědka, informátora a vybraným operativně pátracím prostředkům. Závěrečná část je zaměřena na nástroje ochrany osob v souvislosti se stíháním organizovaného zločinu, především pak možnostem utajení identity svědka a zákonu o zvláštní ochraně svědka.
