dc.description.abstractZavin ní v trestním právu Diplomová práce se v nuje tématu zavin ní v trestním právu, které je obligatorním znakem subjektivní stránky skutkové podstaty trestného inu. Charakterizuje psychiku pachatele ve vztahu k trestnému inu. V eském trestním právu platí zásada odpov dnosti za zavin ní (nullum crimen sine culpa), podle které není trestného inu bez zavin ní. Diplomová práce je rozd lena do p ti kapitol. První kapitola je v nována obecnému úvodu, ve kterém je pojednáno o trestném inu a jeho skutkové podstat . Nejširší prostor je ponechán výkladu o subjektivní stránce trestného inu a jejím obligatorním a fakultativním znak m. Kapitola je zakon ena pojednáním o pojmu viny v trestním právu. Druhá kapitola se v nuje historickému vývoji institutu zavin ní v trestních zákonech, které d íve platily na našem území, a to od období vymezené platností zákona o zlo inech, p e inech a p estupcích až po trestní zákon z roku 1961, který byl v roce 2010 nahrazen sou asným trestním zákoníkem. T etí kapitola pojednává o aktuální úprav zavin ní v trestním právu, v níž je nejv tší ást ponechána výkladu o obecných poznatcích o úprav zavin ní v platném trestním zákoníku, a už jde o zásady, na kterých úprava spo ívá, nebo rozbor ustanovení souvisejících s popisovanou problematikou. dc.description.abstractCulpability in Criminal Law The diploma thesis deals with the topic of culpability in criminal law, which is an obligatory attribute of the subjective aspect of the criminal offence. It characterizes the offender's psyche in relation to the criminal offence. In Czech criminal law, the principle of liability for fault (nullum crimen sine culpa), according to which there is no crime without fault, applies. The diploma thesis is divided into five chapters. The first chapter is focused on the general introduction; in which the crime and its merits are discussed. The largest part is left to the interpretation of the subjective aspect of the criminal offence and its obligatory and facultative characteristics. The chapter concludes with a treatise on the concept of guilt in criminal law. The second chapter deals with the historical development of the institute of culpability in the criminal codes, which used to be applicable in our territory, from the period defined by the applicability of the Act on Crimes, Offenses and Misdemeanours to the Criminal Code of 1961, which was replaced in 2010 by the current Criminal Code.
