Abstract

Demokracie a právní stát: Harmonie, nebo konflikt? Abstrakt Cílem této diplomové práce je vymezit pojem právního státu a pojem demokracie a vystihnout, jaký je jejich vzájemný vztah. Definování právního státu i demokracie je učiněno na základě rešerše odborné literatury a porovnání přístupů jednotlivých autorů. S ohledem na to, že přístupy autorů se zásadně liší a není možné je zahrnout do jediné definice, jsou oba pojmy, demokracie a právní stát, rozděleny do několika subkategorií, a to procedurální a substantivní demokracie, legalistický, formální a materiální právní stát. Přitom materiální právní stát považuje autor této práce za natolik svébytný, že je vhodné jej označovat jiným způsobem. Zvolil pro něj termín ústavní liberalismus. Vlastní vztah demokracie a právního státu se odvíjí od pojetí jednotlivých pojmů, a proto je také tato část práce rozčleněna na kapitoly zabývající se vztahem právního státu a demokracie v závislosti na tom, jak jsou chápány a výše vysvětleny. Obdobná je také metoda, neboť nejdříve byly vyhledány a porovnávány pohledy na vztah právního státu a demokracie v odborné literatuře, aby se následně autor pokusil o zobecnění. Democracy and state governed by law: harmony or conflict? Abstract The aim of this thesis is to define the concept of the state governed by law and the concept of democracy and to describe the relationship between them. The author of the thesis first reviewed literature defining the state governed by law and democracy and then compared different authors' concepts. These concepts are fundamentally different, therefore they cannot be included in a single definition. With regard to it, both concepts, democracy and the state governed by law, are divided into several subcategories: procedural and substantive democracy, legalistic, formal and material state governed by law. Conccurently, the author of this thesis considers the material state governed by law to be so distinctive that it is inappropriate to call it state governed by law. He chose the term constitutional liberalism for it. The relationship between democracy and the state governed by law is determined by concepts of democracy and concepts of the state governed by law, therefore this part of the thesis is also divided into chapters dealing with the relationship between the state governed by law and democracy, depending on how they are understood.
