<description>Test similarity a možné objektivní vymezení jedinečnosti díla v hudebním průmyslu
The similarity test and a possible objective definition of originality in the music industry Abstract This thesis examines the assessment of similarity between musical works and the limits of uniqueness or originality in the modern music industry. It proceeds from the premise that musical space is inherently finite, since the Western twelve-tone system offers only a limited number of melodic motifs and harmonic progressions. Coincidental matches between independently created works are therefore inevitable and will continue to multiply with the exponential growth of content, further amplified by the advent of generative artificial intelligence. The main question of this thesis is thus where a statistically probable coincidence under music theory ends and a copyright dispute begins, and whether the boundary between them can be objectively defined. The thesis first defines the concepts of an author's work and a musical work, and breaks the latter down into its individual components: melodic, harmonic, and kinetic, to which, going beyond the traditional division, it adds the atmosphere of the work. It analyses the significance of each component for the assessment of originality, drawing primarily on Anglo-American case law as the most developed body of case law in this field. Where relevant, the conclusions of...; Test similarity a možné objektivní vymezení jedinečnosti v hudebním průmyslu Abstrakt Tato diplomová práce se zabývá posuzováním podobnosti hudebních děl a hranicemi jedinečnosti či originality v moderním hudebním průmyslu. Vychází z poznatku, že hudební prostor je svou povahou konečný, neboť západní dvanáctitónový systém nabízí omezený počet melodických motivů a harmonických progresí. Náhodné shody mezi nezávisle vytvořenými díly jsou proto nevyhnutelné a s exponenciálním nárůstem obsahu, umocněným nástupem generativní umělé inteligence, budou dále přibývat. Ústřední otázkou práce tedy je, kde končí statisticky pravděpodobná shoda v rámci hudební teorie a kde již začíná autorskoprávní spor a zda lze hranici mezi nimi objektivně vymezit. Práce nejprve definuje pojem autorského a hudebního díla a rozkládá jej na jednotlivé složky, a to melodickou, harmonickou a kinetickou, k nimž nad rámec tradičního dělení přidává ještě atmosféru díla. Význam jednotlivých složek pro posuzování originality analyzuje s oporou převážně v anglosaské judikatuře jakožto nejrozvinutějším systému. Kde je to relevantní, jsou závěry anglosaské judikatury konfrontovány s českou a unijní úpravou. 1 Country-by-Country Reporting Abstract The thesis examines the institute of country-by-country reporting (CbCR). Its aim is to explore how the implementation of CbCR legislation differs across selected countries based on OECD reviews from 2018-2024, in the context of the OECD CbCR framework. To this end, it employs the method of comparative analysis, comparing the results obtained against the criteria set out in the aforementioned OECD framework. Comparative analysis is a method of comparing two or more phenomena, situations, or systems in order to identify their similarities, differences, and patterns. The first part of the thesis focuses on the theoretical foundations of CbCR, addressing the historical development of CbCR, current literature, the BEPS initiative and its fifteen constituent actions, and subsequently Action 13 dedicated to CbCR. The second part first defines the selected countries and comparative criteria, then examines CbCR implementation within individual jurisdictions, and concludes by proposing recommendations to address the identified issues. The analysis shows that the Czech Republic and Germany have implemented CbCR fully in line with the OECD framework according to the applied criteria, although temporary differences existed during the gradual implementation process. By contrast,...; Country-by-Country Reporting Abstrakt Diplomová práce se zabývá institutem vykazování podle jednotlivých zemí, v angličtině známým pod zkratkou CbCR. Konkrétně si klade za cíl prozkoumat, jak se liší implementace legislativy institutu CbCR ve vybraných zemích podle přezkumů OECD z let 2018-2024 v kontextu referenčního rámce OECD pro CbCR. K tomu používá metodu komparativní analýzy, přičemž získané výsledky komparuje podle kritérií uvedených ve zmíněném referenčním rámci OECD. Komparativní analýza je metoda srovnání dvou nebo více jevů, situací nebo systémů s cílem identifikovat jejich podobnosti, rozdíly a vzory. První část diplomové práce se soustředí na teoretické ukotvení institutu CbCR, v níž je pozornost dána historickému vývoji CbCR, aktuálnímu výzkumu, iniciativě BEPS a rozboru jejích konkrétních patnácti částí a následně samotnému opatření č. 13 zasvěcenému CbCR. Druhá část práce nejdříve vymezuje zvolené země a komparační kritéria, poté se již zabývá CbCR v jednotlivých zemích a v závěru navrhuje řešení zjištěných problémů. Z provedené analýzy vyplývá, že Česká republika a Německo mají dle užitých kritérií implementované CbCR plně v souladu s referenčním rámcem OECD, byť existovaly během postupné implementace dočasné rozdíly. Legal Protection of Gameplay and Game Mechanics in Video Games under U.S. and Czech Law Abstract This thesis examines the legal protection of gameplay and game mechanics in video games, with a particular focus on copyright law in the United States and the Czech Republic, while also addressing patent protection as a supplementary means of protection. Given the absence of universally accepted definitions, the thesis first defines the concepts of a game mechanic and gameplay in a manner suitable for subsequent legal analysis. A game mechanic is understood as a specific, rule-defined mode of interaction between the player and the game system, whereas gameplay is conceived more broadly as the dynamic level of play itself, in which game mechanics interact with rules, objectives, responses of the game environment and other components of the video game. The thesis then analyses the development of U.S. copyright case law concerning video game clones and the boundary between an unprotected game idea, rule or functional principle and protectable concrete expression. It identifies factual and argumentative issues arising from U.S. case law that are also relevant to the Czech legal context, without mechanically transposing U.S. doctrines into Czech law. On this basis, gameplay and game mechanics are assessed under Czech...; Právní ochrana gameplaye a herních mechanik ve videohrách v právu Spojených států amerických a České republiky Abstrakt Tato rigorózní práce se zabývá právní ochranou gameplaye a herních mechanik ve videohrách se zaměřením na autorské právo Spojených států amerických a České republiky a doplňkově také na možnosti patentové ochrany. Vzhledem k absenci univerzálně přijímaných definic nejprve vymezuje pojmy herní mechanika a gameplay způsobem použitelným pro následnou právní analýzu. Herní mechaniku chápe jako dílčí, pravidly určený způsob interakce mezi hráčem a herním systémem, zatímco gameplay jako širší a proměnlivou rovinu samotného hraní, v níž se herní mechaniky propojují s pravidly, cíli, odezvou herního prostředí a dalšími složkami videohry. Práce následně analyzuje vývoj americké autorskoprávní judikatury týkající se videoherních klonů a hranice mezi nechráněnou herní ideou, pravidlem či funkčním principem a chránitelným konkrétním vyjádřením. Z americké judikatury identifikuje skutkové a argumentační problémy relevantní také pro české právní prostředí, aniž by americké doktríny mechanicky přenášela do českého práva. Trademark and Copyright: What is Their Mutual Relationship and Application in the Protection of Intellectual Property Rights? Abstract This thesis examines the relationship between, and the comparison and potential applications of, copyright and trademark protection within the intellectual property law system. The thesis first describes the theoretical foundations of both legal frameworks and examines their creation, functioning, and termination, while also analyzing situations in which these two distinct protection regimes overlap with respect to a single, identical intangible asset. The thesis also includes an analysis of the main differences between the two legal frameworks in terms of the manner of their creation, scope, termination, transferability, and duration of subjective rights, with these aspects being illustrated throughout the individual chapters using practical examples. The coexistence of copyright and trademark law systems simultaneously represents a specific dualism, in which the former, copyright law, functions as a strong counterbalance to the trademark monopoly. While a trademark, unlike copyright, is subject to a strict registration requirement, it nevertheless allows its owner, through regular renewal of the registration, to enjoy theoretically indefinite protection. Abstrakt Tato diplomová práce se zabývá vzájemným vztahem, komparací a možnostmi uplatnění autorskoprávní a známkoprávní ochrany v rámci systému práva duševního vlastnictví. Práce nejprve popisuje teoretická východiska obou institutů a rozebírá jejich vznik, fungování a zánik, a zároveň analyzuje situace, kdy se tyto dva odlišné ochranné režimy střetávají u jednoho totožného nehmotného statku. Součástí práce je rovněž analýza hlavních rozdílů, které obě úpravy přinášejí z hlediska způsobu jejich vzniku, rozsahu, zániku, převoditelnosti a délky trvání subjektivních práv, přičemž tyto aspekty jsou v jednotlivých kapitolách průběžně demonstrovány i na praktických případech. Vedle sebe fungující režimy autorského a známkového práva současně mohou představovat určitý a specifický dualismus, kdy dřívější autorské právo pak funguje jako silný korektiv známkoprávního monopolu. Ochranná známka oproti autorskému právu sice podléhá přísnému registračnímu principu, na druhé straně však svému vlastníkovi umožňuje skrze pravidelnou obnovu zápisu teoreticky nekonečné trvání ochrany.
