Etické výzvy komerční nezdravotnické organizace poskytujícípsychoterapeutické poradenství Ethical challenges of commercial organizations providing psychotherapy Abstract The diploma thesis addresses the ethical topics related to the operation of commercial organizations that provide psychotherapy outside the healthcare system in the Czech Republic. The topic is set within the context of a legislative change that, effective July 1, 2026, defines psychotherapy outside the healthcare system as a trade requiring professional qualification and transforms the legal and regulatory framework for the provision of these services. In this context, the thesis emphasize ethical issues associated with the company management providing mental health care. The actions of these companies' management are influenced by the pressure to achieve economic goals as well as the necessity to adhere to the ethics of the helping professions. The thesis focuses on selected ethical conflicts emerging within the environment of these organizations, particularly on issues concerning the organization's relationship with therapists, economic management, and the presentation of services to the public. Téma je zasazeno do kontextu legislativní změny, která s účinností od 1. července 2026 vymezuje psychoterapii mimo zdravotnictví jako vázanou živnost s názvem Poskytování služeb v oblasti poradenské psychoterapie a tím proměňuje právní a regulační rámec poskytování těchto služeb. V této souvislosti se akcentují etické problémy spojené s fungováním subjektů poskytujících péči o duševní zdraví. Jednání managementu těchto firem ovlivňuje tlak na dosahování ekonomických cílů i nutnost dodržovat etiku pomáhajících profesí. Dítě jako osoba This thesis addresses the question of whether children, particularly of school age, can be understood as persons, and what implications this understanding has for pedagogical practice. To answer this question, four philosophical conceptions of personhood are analysed: the ontological approach of Robert Spaemann, the deontological approach of Immanuel Kant, the teleological approach rooted in Aristotelian virtue ethics, and the phenomenological approach of Emmanuel Levinas. Each conception is systematically presented through its key concepts, then related to the question of the moral status of the child, and pedagogical implications are drawn from each. The thesis demonstrates that, despite significant differences in approach, all four traditions share a rejection of functionalist conceptions of personhood and converge on the conclusion that children cannot be excluded from the moral world. On the basis of comparative analysis, four concrete requirements for pedagogical practice are formulated, and a reasoned personal position is offered regarding which tradition provides the strongest foundation for the ethics of pedagogical practice.; Tato diplomová práce se zabývá otázkou, zda lze děti, a to zejména ve školním věku, chápat jako osoby, a jaké důsledky má toto chápání pro pedagogické jednání. K zodpovězení této otázky jsou analyzována čtyři vybraná filosofická pojetí osoby: ontologické pojetí Roberta Spaemanna, deontologické pojetí Immanuela Kanta, teleologické pojetí vycházející z aristotelské etiky ctností a fenomenologické pojetí Emmanuela Lévinase. Každá z těchto koncepcí je nejprve systematicky představena v klíčových pojmech, poté vztažena k otázce morálního statutu dítěte a z ní jsou vyvozeny pedagogické implikace. Práce ukazuje, že přes výrazné rozdíly v přístupu se všechny čtyři tradice shodují v odmítnutí funkcionálního pojetí osoby a v závěru, že dítě nelze z morálního světa vyloučit. Na základě srovnávací analýzy jsou formulovány čtyři konkrétní požadavky na pedagogické jednání a je nabídnuto vlastní stanovisko k otázce, která tradice poskytuje nejsilnější základ pro etiku pedagogické praxe.

To provide a more comprehensive perspective, the thesis is situated within the broader context of psychotherapy and ethics. The theoretical section defines the concept of psychotherapy, introduces various psychotherapeutic approaches, and analyzes the factors contributing to the success of psychotherapy. It further focuses on ethics in psychotherapy, its historical development, key ethical principles, and the Code of Ethics of the Czech Association for Psychotherapy. The empirical part of the thesis is based on informal pilot research conducted through interviews with psychotherapists and on an analysis of professional literature and available research. The aim of the thesis is to identify the most significant ethical challenges that arise from the perspective of the therapist, the client, and the therapeutic relationship. At the same time, it seeks to highlight possible solutions in accordance with professional and ethical standards. Za účelem komplexnějšího pohledu je práce zasazena do širšího rámce psychoterapie a etiky. Teoretická část vymezuje pojem psychoterapie, představuje jednotlivé psychoterapeutické proudy a analyzuje faktory podílející se na úspěšnosti psychoterapie. Dále se zaměřuje na etiku v psychoterapii, její historický vývoj, klíčové etické principy a Etický kodex České asociace pro psychoterapii. Empirická část práce vychází z neformálního pilotního výzkumu realizovaného prostřednictvím rozhovorů s psychoterapeuty a z analýzy odborné literatury a dostupných výzkumů. Cílem práce je identifikovat nejvýznamnější etické výzvy, které se objevují z pohledu terapeuta, klienta a terapeutického vztahu. Současně se snaží poukázat na možnosti jejich řešení v souladu s profesními a etickými standardy. Mezikulturní manželství jako střet hodnot a náboženských představ This thesis deals with intercultural and interreligious marriages as a space in which different value systems, cultural expectations and religious frameworks meet and may come into conflict. The theoretical part presents marriage as a social, cultural, legal and religious institution and analyses the role of values, cultural differences and religious identity in partner relationships. Special attention is paid to the Catholic and Islamic understanding of marriage, including their practical implications for fidelity, family life, parenthood and the religious upbringing of children. The analytical part works with selected case studies of intercultural relationships. These case studies are not treated as representative empirical research, but as qualitative and interpretative material that makes it possible to show specific areas of tension: communication, gender roles, the influence of the wider family, religious practice, upbringing of children, adaptation to a different environment and the setting of personal boundaries. Teoretická část představuje manželství jako sociální, kulturní, právní a náboženskou instituci a analyzuje význam hodnot, kulturních rozdílů a náboženské identity pro fungování partnerských vztahů. Zvláštní pozornost je věnována katolickému a islámskému pojetí manželství, včetně praktických důsledků pro věrnost, rodinný život, rodičovství a náboženskou výchovu dětí. Analytická část pracuje s vybranými případovými studiemi mezikulturních vztahů.
